83.25. License Requirements--Continuing Education. (a) Terms used in this section have the meanings assigned by Chapter 59 of this title, unless the context indicates otherwise.
(b) To renew an operator or instructor license that expires prior to September 1, 2008, a licensee must complete a total of 12 hours of continuing education through department approved courses, of which 4 hours must be in Sanitation required under the Act and 16 Texas Administrative Code, Chapter 83.
(c) To renew a manicure instructor specialty license, manicurist specialty license, facial instructor specialty license, facialist specialty license, hair weaving specialty certificate, hair braiding specialty certificate, wig specialty certificate, and shampoo/conditioning specialty certificate that expires prior to September 1, 2008, a licensee must complete a total of 8 hours of continuing education through department-approved courses, of which 4 hours must be in Sanitation required under the Act and 16 Texas Administrative Code, Chapter 83.
(d) If a licensee holds an instructor license, facial instructor specialty license, or manicure instructor specialty license that expires prior to September 1, 2008, then, of the total hours required under subsections (b) or (c), the licensee must complete 2 hours in Methods of Teaching in accordance with §83.120.
(e) To renew an operator license, manicurist specialty license, facialist specialty license, hair weaving specialty certificate, hair braiding specialty certificate, wig specialty certificate, or shampoo/conditioning specialty certificate that expires on or after September 1, 2008, a licensee must complete a total of 6 hours of continuing education through department-approved courses. The continuing education hours must include the following:
(1) 2 hours in Sanitation required under the Act and 16 Texas Administrative Code, Chapter 83;
(2) 2 hours in the Act and 16 Texas Administrative Code, Chapter 83, addressing topics other than Sanitation; and
(3) 2 hours in any topics listed in subsection (j).
(f) To renew an instructor license, manicure instructor specialty license, or facial instructor specialty license that expires on or after September 1, 2008, a licensee must complete a total of 6 hours of continuing education through department-approved courses. The continuing education hours must include the following:
(1) 2 hours in Sanitation required under the Act and 16 Texas Administrative Code, Chapter 83;
(2) 2 hours in the Act and 16 Texas Administrative Code, Chapter 83, addressing topics other than Sanitation; and
(3) 2 hours in methods of teaching in accordance with §83.120.
(g) For a timely or a late renewal, a licensee must complete the required continuing education hours within the two year period immediately preceding the renewal date.
(h) A licensee may receive continuing education hours in accordance with the following:
(1) A licensee may not receive continuing education hours for attending the same course more than once.
(2) A licensee will receive continuing education hours for only those courses that are registered with the department, under procedures prescribed by the department.
(i) A licensee shall retain a copy of the certificate of completion for a course for two years after the date of completion. In conducting any inspection or investigation of the licensee, the department may examine the licensee’s records to determine compliance with this subsection.
(j) To be approved under Chapter 59 of this title, a provider’s course must be dedicated to instruction in one or more of the following topics:
(1) Sanitation required under the Act and 16 Texas Administrative Code, Chapter 83;
(2) the Act and 16 Texas Administrative Code, Chapter 83, addressing topics other than Sanitation;
(3) the curriculum subjects listed in 16 Texas Administrative Code, §83.120.
(k) A registered course may be offered until the expiration of the course registration or until the provider ceases to hold an active provider registration, whichever occurs first.
(l) A provider shall pay to the department a continuing education record fee of $5 for each licensee who completes a course for continuing education credit. A provider’s failure to pay the record fee for courses completed may result in disciplinary action against the provider, up to and including revocation of the provider’s registration under Chapter 59 of this title.
(m) Notwithstanding subsections (b) through (f) a licensee may satisfy the continuing education requirement for renewal by completing two hours of Sanitation in department-approved courses, if the licensee:
(1) is at least 65 years of age; and
(2) has held a cosmetology license for at least 15 years.

For holders of an Electricians licenses, four (4) hours of TDLR approved continuing education courses is required to renew that license. The required hours must cover the National Electrical Code (NEC) and Texas state electrician law and rules.
NOTE: Apprentice Electricians, Electrical Contractors, and Electrical Sign Contractors are not required to meet the continuing education requirement for renewal.
Continuing education courses must be completed within the term of the license being renewed. For example, if a license expires on June 15, 2006, the continuing education courses taken to renew that license must have been taken between June 15, 2005 and June 15, 2006.
For a late renewal, the continuing education courses must have been completed within the one year period immediately prior to the date of renewal.
Licensees may not receive continuing education credit for attending the same course more than once for one renewal period. Further, licensees must retain a copy of the certificate of completion for a course for one year after the date of completion. In conducting any inspection or investigation of the licensee, the department may examine the licensee’s records to determine compliance.
Please note that the reporting of continuing education hours is the responsibility of the continuing education provider. Licensees may check their hours from the program's CE link to "Check the CE course you have completed." If the hours have not been reported, the licensee should contact the provider first to ensure that the hours are reported. If the reporting issue is not resolved, they have the option of filing a complaint.
Sec. 1001.055. DRIVER EDUCATION CERTIFICATES

(a) The agency shall print and supply to each licensed or exempt driver education school driver education certificates to be used for certifying completion of an approved driver education course to satisfy the requirements of Section 521.204(a)(2), Transportation Code. The certificates must be numbered serially.
(b) The agency by rule shall provide for the design and distribution of the certificates in a manner that, to the greatest extent possible, prevents the unauthorized reproduction or misuse of the certificates.
(c) The agency may charge a fee of not more than $4 for each certificate.
Sec. 1001.056. UNIFORM CERTIFICATES OF COURSE COMPLETION.
(a) In this section, "operator" means a person approved by a course provider to conduct an approved driving safety course.
(b) The agency shall print and supply to each licensed course provider uniform certificates of course completion. The certificates must be numbered serially.
(c) The agency by rule shall provide for the design and distribution of the certificates in a manner that, to the greatest extent possible, prevents the unauthorized production or misuse of the certificates.
(d) A certificate under this section must:
(1) be in a form required by the agency; and
(2) include an identifying number by which the agency, a court, or the department may verify its authenticity with the course provider.
(e) The agency may charge a fee of not more than $4 for each certificate. A course provider shall charge an operator a fee equal to the amount of the fee paid to the agency for a certificate.
(f) A course provider license entitles a course provider to purchase certificates for only one approved driving safety course.
(g) The agency shall issue duplicate certificates. The commissioner by rule shall determine the amount of the fee for issuance of a duplicate certificate.
Sec. 1001.057. ELECTRONIC TRANSMISSION OF DRIVING SAFETY COURSE
INFORMATION.
The agency shall investigate options to develop and implement procedures to electronically transmit information relating to driving safety courses to municipal and justice courts.

SUBCHAPTER C. CURRICULUM
Sec. 1001.101. DRIVER EDUCATION COURSE CURRICULUM AND TEXTBOOKS.
The commissioner by rule shall establish the curriculum and designate the textbooks to be used in a driver education course.

For holders of Air Conditioning and Refrigeration Contractor licenses expiring on or after January 1, 2006, eight hours of TDLR approved continuing education courses will be required to renew that license. Two of these eight hours must be instruction on Texas laws and rules that regulate the conduct of Air Conditioning and Refrigeration Contractors. The other six hours must be courses taken in one or more of the following subjects:

TOWING TDLR Requirements
To renew a towing operator license, a licensee must complete a total of four (4) hours of continuing education through Department-approved courses. The continuing education hours must include one (1) hour in roadway safety, one (1) hour in Texas law and rules that regulate the conduct of towing operators; and two (2) hours in industry related topics. Refer to Section 86.250 of the Vehicle Towing Administrative Rules for additional information.
To renew an Incident Management (IM) towing operator license for the first (1st) time, a licensee must complete, in lieu of the continuing education, a professional development course relating to towing that consists of eight (8) hours of training. This training must include at least two (2) hours of live demonstration and hands-on training, at least two (2) hours of classroom training; and any remaining hours in classroom training or live demonstration and hands-on training.
The professional development course must include the following topics: how light-duty tow trucks work, towing with a wheel lift, towing with a tow sling, using tow dollies, car carrier operation, vehicle recovery, light-duty tow trucks, field procedures, vehicle maintenance; and safety. The course may be offered by or through a Department-approved provider, including a community college, college or university.
Continuing education courses must be completed within the term of the license being renewed. For example, if a license expires on June 15, 2009, the continuing education courses taken to renew that license must have been taken between June 15, 2008 and June 15, 2009.
For a late renewal, the continuing education courses must have been completed within the one year period immediately prior to the date of renewal.

Further, licensees must retain a copy of the certificate of completion for a course for one year after the date of completion.
